| PFFNH Goes to Court against Retirement System
Yesterday the PFFNH and the State Employees Association (SEA-NH SEIU L1984),New Hampshire Police Association, NH Association of Chiefs of Police, NH Permanant Fire Fighters Retirement Association,NH Association of Fire Chiefs, and NEA-NH asked the superior court in Merrimack County to order the NHRS to follow the law (Writ of Mandamus) and continue the medical subsidy with the 8% escalator.
In a joint effort the associations noticed the NHRS through its Chair that the system needs to follow the law, replacing the cost of the 401 (h) subsidy with money from the special account. The special account was established as a place to deposit earnings over and above the actuarial rate of return, (investment return needed to fund the pension). The medical subsidy for police and fire has been in place since 1988 with the transfer of $52.8 million. This money was set aside to fund the medical subsidy and reimburse the employers so it would be cost neutral for them.
Last Wednesday Marcia Wagner from the Wagner Law Group presented her opinion that the consultant for the NHRS Ice Miller’s opinion missed the mark and the medical subsidy, the 8% escalator and reimbursing the employers for the cost could continue. This opinion can be found on the PFFNH website at the Retirement System Update in the member's area.
The LGC has been collecting money from the local communities in order to fight this issue on an unfunded mandate (28.a issue). Today the affected organizations came together filed suit, and sent a strong message. That you can provide the benefits to our members
that was promised and make sure the taxpayers pay what they are supposed to .
